TERMS OF SALE
By registering as a buyer or consignor, or bidding on a horse at Teens and Oregon Mustangs / MESA, all parties agree to the following Terms of Sale.

Catalog Fee
-
The catalog fee is $250 per head and is non-refundable.

Private Sale Restriction
-
Upon execution of this contract, the Consignor agrees not to dispose of the horse by private sale.

-
No Replacements
-
No replacement horses will be accepted. This contract is binding and, once received, no substitute or replacement horses will be accepted.

Agency Disclaimer
-
Teens and Oregon Mustangs, MESA, and their associates act as agents only and are not responsible for buyer/seller error or misunderstanding. All guarantees are strictly between the buyer and seller, except as provided in the soundness guarantee. All horses are sold “as is” without any express or implied warranties.

Soundness Requirement
-
Consignors are required to provide a certificate of soundness with regard to sight, wind, and limb, from a certified veterinarian, by August 1st, 2026.
-
Horses are sold as sound. Soundness is defined as:
-
Horse travels at all gaits with no visible sign of discomfort or distress
-
Horse has no audible hindrance in breathing
-
Horse gives indication of seeing out of both eyes
-

Any questions of soundness arising within 5 days of the sale will be decided by Dr. Soloman Bennaroch.
-
The Buyer accepts all responsibility for any and all injury incurred after the drop of the hammer.

Health Requirements
-
An individual negative Coggins Test, current within 30 days prior to the sale, is required for each horse, along with a valid health certificate.
-
Additionally, each horse is required to have proof of vaccination for:
-
Influenza
-
Eastern Encephalitis
-
Western Encephalitis
-
Rhino Virus
-
Tetanus
-
-
These vaccinations must have been administered within 6 months of the sale.
-
West Nile vaccination is also recommended.
-
-
Sales Commission
-
The commission will be eight percent (8%) of the selling price.
-
-
No Sale / Pass Out Privilege
-
The Consignor will have the privilege to No Sale (Pass Out) their horse.
-
No Sales / Pass Outs must be declared immediately when the gavel drops, while the horse is still in the ring.
-
An 8% commission will be charged on the final bid.
-
The catalog fee will not be refunded.
-
Paperwork on the horse will be held until all fees are paid.
-

Commission on All Sold Horses
-
All consigned horses sold before, during, or after the sale will be subject to the 8% sales commission, in addition to the catalog fee.
-
All consignments must go through the sale ring.
-
-
Withdrawal of Entry
-
Consignor agrees not to withdraw an entry except for serious injury or sickness and will furnish Horse Resource Sales / MESA with a notarized veterinary statement prior to the sale.

Disclosure of Defects
-
Any defects or bad habits must be announced while the horse is in the ring, including but not limited to:
-
Cryptorchid
-
Cribber
-
Lameness or Unsoundness
-
Parrot Mouth
-
Scars
-
Corrective Shoes
-
Other known defects or vices
-
-
-
Horse Requirements
-
All horses must have a title from the BLM. Title must be verifiable against the brand on the horses’ neck. Horse must be registered with the IMHA and compete in AT LEAST one class the weekend of the sale.
-
Stall fees for the weekend are reduced, and sellers will be reimbursed $25/night on their final check.
-

Marketing Materials
-
The Consignor is responsible for providing quality marketing material for each horse to Teens and Oregon Mustangs / MESA.
-
Teens and Oregon Mustangs/MESA has the right to use any submitted videos and pictures on social media, websites, and any other marketing/advertising avenues.
-
The Consignor is also responsible for reviewing and approving horse listings online and as requested.
-
Teens and Oregon Mustangs, MESA, and their affiliates are not responsible for misrepresentations of horses in marketing, including but not limited to:
-
verbal statements
-
digital media
-
printed materials
-
-
-
Consignment Position
-
A horse’s position in the sale will not be secured until the following are received complete and in full by Teens and Oregon Mustangs / MESA:
-
this signed contract
-
release of liability
-
consignment fee
-
approved application
-
verification of entry into at least one IMHA class
-
-
-
Accepted Forms of Payment
-
Accepted forms of payment for sale purchases include:
-
Cash
-
Cashier’s Check
-
Personal Check (with Picture Identification)
-
Credit Card (4% convenience fee charged to buyer)
-
Payment methods and fees are subject to change.

Catalog and Printed Material Disclaimer
-
Data provided in the Teens and Oregon Mustangs / MESA catalog is generally believed to be correct. However, errors may occur due to:
-
incorrect data received from others
-
processing mistakes
-
other causes
-
-
Teens and Oregon Mustangs, and MESA disclaim liability for such errors, but appreciate having them brought to their attention.
-
Announcements from the auction block take precedence over printed material.
-
-
Risk, Title, and Liability After Sale
-
All risk of injury to, and responsibility for, the horse becomes the Buyer’s risk at the fall of the hammer.
-
Title passes to the Buyer upon completion of payment.
-
Buyer and Seller agree to release, defend, indemnify, and hold harmless the owners, managers, and employees from all losses, expenses, and claims related to the possession, care, custody, control, or maintenance of any horse after the fall of the hammer.
-
This includes claims arising in whole or in part from negligence, including but not limited to injuries or damage caused by the horse after the sale.

Shipping Liability and Insurance
-
Teens and Oregon Mustangs / MESA assume no liability for loss or damage during shipment.
-
Coordination of shipping will be between the buyer and seller.
-
Teens and Oregon Mustangs strongly recommends insurance before shipping.
-

Buyer Settlement
-
The horse will be held for the Buyer until the Buyer makes settlement as provided.
-
The Buyer shall immediately present themselves to make settlement if requested by the auctioneer, but in any case, must do so within of the conclusion of the sale.
-
At the time of settlement, the Buyer is responsible for checking:
-
title paperwork
-
transfer documents
-
additional paperwork
-

Seller Settlement
-
Checks will be sent out to the seller within 30 days of the auction close.
-
The below fees will be deducted or added from the sale check:
-
8% sale commission
-
$25/night will be refunded for stall fee and added to final check
-

-
No Warranty / Title / Delivery Disclaimer
-
Teens and Oregon Mustangs / MESA makes no representation or warranty concerning:Any of the horses to be auctioned at the sale
-
The accuracy or completeness of the listings or descriptions of the livestock
-
The ability of any Seller to convey ownership of the livestock to Buyer
-
A Seller’s ability to deliver good and marketable title to any horse purchased at auction
-
Teens and Oregon Mustangs / MESA does not take title to, nor does it assume responsibility for, the transfer of ownership of any livestock sold at auction.
-
It also does not guarantee payment or delivery with respect to any transaction undertaken at the sale.
-
Seller and Buyer hereby release Teens and Oregon Mustangs and MESA from any claims, demands, or damages arising out of or in any way connected with the bidding, purchase, or sale of livestock at the sale.

Buyers agree to look solely to the Seller for physical delivery of the livestock purchased.

Post-Sale Requirement
-
Any horses remaining onsite 3 hours after the conclusion of the sale without prior arrangements with Teens and Oregon Mustangs/ MESA directly will be considered abandoned and removed from the property that evening. Board will begin at the rate of $50/day until the horse is picked up in Yamhill, Oregon. The board payment is the responsibility of the buyer and must be paid before the horse is picked up.
